We never condone deliberate and wilful breaches of planning control. However, it is sometimes possible to regularise a breach of planning control by negotiating retrospective planning permission; or by preparing applications for Certificates of Lawful Development or Lawful Use to establish immunity from enforcement action. We always approach such cases carefully, giving honest professional advice to our clients and by dealing honestly and openly with the Local Authority.
Sometimes, there is no option but to respond for clients to enforcement action instigated by a Local Authority. We co-ordinate enforcement appeals by written representations and by public inquiry, working with our clients and co-consultants as necessary, often with the assistance of Planning Silk or Planning Counsel. Mat Utting has given evidence on oath on several occasions in the past, which is a weighty personal and professional responsibility.
